Poulter Notary Services Effective Date: 6/18/2025. These Terms and Conditions ("Agreement") govern the use of notary services provided by [Your Notary Business Name] ("we," "us," "our") to clients ("you," "your"). By requesting or using our services, you agree to be bound by these Terms.
1. Scope of Services
We offer professional notarial services in accordance with Nevada Revised Statutes (NRS Chapter 240). These services may include:AcknowledgmentsJurats (Oaths and Affirmations)Copy certifications (when permitted)Signature witnessingRemote Online Notarization (RON)Mobile notary appointmentsWe do not provide legal advice, document preparation, or interpretation of the documents being notarized.
2. Client Responsibilities
You agree to:Provide valid, unexpired government-issued identificationBe physically present (or available via audio-video technology if using RON) at the time of notarizationEnsure that all documents are complete and ready for notarization (we will not notarize blank or incomplete documents)Be of sound mind and not under duress or coercionNotify us in advance of any accessibility or accommodation needsIf a signer appears unwilling, confused, or otherwise incapable of understanding the document, we reserve the right to refuse service.
3. Fees and Payment
Notary fees are charged in accordance with Nevada law and may include:Standard notarization fees (per signature or act)Travel fees for mobile servicesTechnology fees for remote online notarizationAfter-hours, weekend, or holiday service fees (if applicable)All fees will be disclosed prior to the appointment. Payment is due at the time of service unless otherwise agreed in writing.
4. Cancellations and No-Shows
We understand that changes happen. Please provide at least 2 hours’ notice for cancellations or rescheduling. A fee may apply for:Cancellations with insufficient noticeMissed appointments where the signer is not availableSituations where notarization cannot be completed due to client non-compliance
5. Right to Refuse Service
We reserve the right to refuse or discontinue services if:Identification is not provided or is invalidThe signer is not present or unwillingThe document is incomplete or suspiciousThe notarization would violate Nevada law or ethical guidelines
6. Recordkeeping
As required by Nevada law, we may retain records of notarizations performed, including signer's name, document type, date, and identification details. These records are securely maintained for a minimum of 7 years, as per NRS 240.120.
7. Limitation of Liability
Our notary services are provided in good faith and in accordance with applicable law. We are not liable for:The legal effect or content of the notarized documentErrors or omissions caused by the clientDelays or non-performance due to events beyond our control (e.g., emergencies, weather, technology failure)Our liability, if any, is limited to the amount paid for the notarial service in question.
8. Privacy
We respect your privacy and handle your personal information in accordance with our Privacy Policy. We do not sell or share personal information without consent, except as required by law.
9. Governing Law
This Agreement shall be governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes will be handled in the appropriate courts within the state.
10. Modifications
We reserve the right to update or modify these Terms and Conditions at any time. Updates will be posted on our website with a new effective date. Continued use of our services constitutes acceptance of any revised terms.
